National ID e-Verify
Terms of Use
These Terms of Use shall govern the utilization of the National ID eVerify system and provide information about the Philippine Statistics Authority (PSA) and process of onboarding as a relying party of the Philippine Identification System (PhilSys).
1. WHO CAN ACCESS THE NATIONAL ID eVERIFY
The National ID eVerify is open to the public. Users who may access the National ID eVerify are classified into three (3) types:
- General public – Individuals who visit and view information on the National ID eVerify.
- Authorized Representative - Any representative from government offices, financial institutions, private entities, and other organizations who intend to integrate with the PhilSys and consume its authentication services. Authorized representatives shall be required to create an account to access and use the features of the National ID eVerify.
- Authorized PSA Personnel - Any PSA personnel involved in the processing of applications as a PhilSys relying party. These personnel need to create an account in the National ID eVerify to be able to process submitted applications from prospective relying parties.
2. ACCEPTABLE BEHAVIORS
Depending on their classification, users of the National ID eVerify system can:
- For the General Public:
- Visit and view information on the National ID eVerify (e.g., RP List and TSP List); and
- Create a National ID eVerify account.
- For Authorized Representatives:
- Create and manage a National ID eVerify account;
- Submit requirements for the onboarding of his/her organization as a relying party of the PhilSys;
- Review and monitor the status of their onboarding application;
- Manage his/her organization’s subscription/s to the PhilSys authentication services;
- View lists of accredited RPs and Trusted Services Providers; and
- View the latest news and updates on the PhilSys and its onboarding process.
- For PSA Personnel:
- Manage a National ID eVerify account;
- Access submissions from relying parties;
- Process the application of a relying party based on his/her level of access; and
- Access the different modules in the National ID eVerify based on his/her level of access.
3. RESTRICTIONS
All users of the National ID eVerify shall refrain from:
- Violating any laws, policies, rules, or regulations;
- Forging or manipulating the document, logo, and any identifier to disguise the origin of any submitted information of a relying party;
- Creating any computer code, programs, or contents that destroy or limit the functionality of the National ID eVerify; and
- Engaging in any form of activities constituting fraud or dishonesty through deception (e.g. impersonation, willful misconduct, misrepresentation, among others).
4. USER LIABILITY
- For General Public:
- Liable for any illegal activities done using the information gathered in the National ID eVerify.
- For Authorized Representatives:
- Liable for any information uploaded or shared in the National ID eVerify on behalf of their agency/office/company/organization;
- Liable for any unlawful acts, as stipulated in item #3 (Restrictions) and other applicable laws, rules, and regulations, committed while using the National ID eVerify.
- Liable for any fraudulent activities committed that resulted in manipulation of their agency/office/company/organization and to PSA.
- PSA Personnel:
- Liable for the protection and security of any personal or sensitive personal information shared by the authorized representative of an agency/office/company/organization;
5. RESPONSIBILITY OF PSA
As the agency primarily tasked to implement the provisions of Republic Act No. 11055 or the Philippine Identification System Act, the PSA shall issue rules on the implementation and enhancement of the PhilSys, including, but not limited to the management of use cases and onboarding of relying parties.
The PSA further adheres to the provisions of RA 11073, otherwise known as the Data Privacy Act of 2012, and all issuances and advisory opinions issued by the National Privacy Commission related to privacy and security.
6. LIMITATION OF LIABILITY
Upon accessing the National ID eVerify, the user expressly agrees that the PSA, including its officials and personnel, shall not be liable, under any law or in equity, to the user, company or organization that the user represents, or to any third party for any direct, indirect, or incidental loss of profits, special or consequential, punitive or exemplary damages, including, but not limited to, damages for loss of profits, goodwill, use, data, or other intangible losses.
7. TERMINATION CLAUSE
The PSA may immediately terminate the user’s access to the National ID eVerify, with or without notice, at any time, without liability to the user, company or organization that the user represents, or to any third party, if proven that the user committed any of the restrictions indicated in the Terms of Use, or any other violation decided by the PSA and deemed sufficient justification for the termination of the account.
8. LEGAL AND ACCEPTABLE USE OF NATIONAL ID eVERIFY
The National ID eVerify must be used in accordance with the prescribed Terms of Use. Access and use must be only for legal, authorized, and acceptable purposes.
9. ACCEPTANCE OF TERMS OF USE
The user must agree, and signify their concurrence, with these Terms of Use prior to using the National ID eVerify.
The National ID eVerify is protected by copyright, trademark, and other applicable laws of the Republic of the Philippines. Nothing in the Terms of Use gives the user the right to use the National ID eVerify or any of the logos, domain names, distinctive brand features, data, and information beyond its intended use.
